The Investigators Who Started Looking at Ilhan Omar Were Democrats

Ilhan Omar has spent the past two weeks calling the search of her Washington home and the federal probe into her immigration records a political hit job. The record shows something else. The first serious look at whether she married her brother to help him stay in the country began under Barack Obama. A second examination of the same family paperwork took place while Joe Biden was president. Both times the people in charge were Democrats. Both times the cases were closed without charges. The questions did not start with the current administration.

What the Obama Team Found

In the summer of 2016 the FBI and the Department of Homeland Security opened an investigation into Omar’s 2009 marriage to Ahmed Nur Said Elmi, a British citizen. At the time Omar was already a U.S. citizen. She and Elmi divorced in 2017. Current and former officials familiar with the 2016 probe say agents developed evidence that the marriage was fraudulent. The statute of limitations on a felony marriage-fraud charge had already expired, so prosecutors did not pursue it. A local news report that August noted the U.S. Attorney’s office in Minnesota was looking at the matter. The office issued a short letter stating it was not investigating her. The file stayed open long enough for agents to document their findings and then went quiet.

Omar was running for the Minnesota House that year. The investigation was not a secret to the people who held power in Washington. Obama has now called the renewed inquiry “appalling.” He has not explained why his own administration reached the conclusion that the marriage raised red flags.

The Biden Years

A U.S. Attorney appointed by Biden later closed the marriage inquiry in 2021. Separately, officials under Biden were briefed on concerns about the citizenship paperwork Omar and her father filed after the family arrived from Somalia. Those concerns centered on whether her birth date had been listed in a way that let her derive citizenship as a minor when her father naturalized in 2000. The agency responsible for immigration investigations declined to open a full probe on those allegations at the time. No charges resulted. Omar continued to serve in Congress.

What Is Happening Now

The current investigation has revived both sets of questions. Agents searched Omar’s Washington residence on October 12 and carried out boxes of documents. Family members have received grand-jury subpoenas. Officials have said the inquiry looks at possible false statements on immigration forms, including the birth-date issue and the 2009 marriage. Omar has denied any wrongdoing and has not been charged. She has described the search as an effort to intimidate her. The earlier investigations that first examined the same facts were conducted by Democratic administrations. Those facts remain the same regardless of who holds the White House.
